PART I – GENERAL


 

NAME

1. The name of this section shall be “The Malaysian Chinese Association Youth Section”, or “MCA Youth Section” by abbreviation (hereinafter referred to as “the Youth Section”).
2. These Bye-laws may be cited as the MCA YOUTH SECTION 1997 BYE-LAWS.

OBJECT

3.

The object of the Youth Section is to encourage Youth Members of the Malaysian Chinese Association (hereinafter shall be referred to as “MCA”) to carry out the Party’s aims, objects and policies.

ADDRESS

4. The Youth Section Secretariat and place of meetings shall be at Wisma MCA, No. 163, Jalan Ampang, 50450 Kuala Lumpur or at such other place or places as may be determined from time to time by the Youth Central Committee.

 


PART II – MEMBERSHIP


 

(5) QUALIFICATION

5.1

All MCA members who are of the age of forty-five (45) or below shall become Youth Members.

5.2 Except as provided in Sub-Clause 5.3 below, the membership of a Youth member In the Youth Section shall automatically terminate on 31st day of December of the year in which he attains the age of forty-five (45) years old.
5.3 Youth Members who are elected or appointed to office or elected Delegates at any level of the Youth Section during the final year of their Youth memberships shall have their memberships extended to enable them to serve out their full terms of office respectively and thereafter their respective memberships and terms of office shall automatically terminate.

 

(6) CESSATION OF MEMBERSHIP

 

A MCA member who:

6.1 terminates his membership in accordance with Article 18 of the MCA Constitution
6.2 dies; or
6.3 is expelled in accordance with Part XV of the MCA Constitution, shall also cease to be a Member of the Youth Section.


PART III – RIGHTS AND DUTIES


 

(7) RIGHTS

 

Unless otherwise provided in these By-laws, and in addition to his rights as MCA members, a Youth member, so long as he has not ceased to be an MCA member for any reason, shall be entitled:

7.1 to attend and speak at all Youth Section meetings which he is entitled to attend;
7.2 to vote at all Youth Section meetings which he is entitled to attend;
7.3 to hold such office or offices in the Youth Section to which he may be duly elected or appointed ; and
7.4 to have access to and to make such reasonable use of such facilities as the Youth Section may provide.

 

(8) DUTIES

 

It shall be the duties of all Youth Section members at all times:

8.1 to pay their MCA subscriptions;
8.2 to uphold and practise the principles laid down in the MCA Constitution; and
8.3 to obey and abide by the constitution of the MCA and the Youth Section Bye-Laws.

 


PART IV – BRANCH YOUTH SECTION


 

(9) ESTABLISHMENT

 

A Youth Section shall be deemed established in any MCA Branch which has twenty five (25) or more Youth Members in its Members’ Register.

(11) EXECUTIVE AUTHORITY

 

Subject to these Bye-Laws, Standing Rules and Orders, the executive authority of a Branch Youth Section is granted by the Branch Youth Assembly and all executive functions shall be exercised by the Branch Youth Committee under the authority and direction of the Branch Youth Assembly. 

 

(12) BRANCH YOUTH ASSEMBLY

 

Articles 96, 97, 98, 99 and 101 of the MCA Constitution relating to Branch Assembly and Extraordinary Meeting of the Branch Assembly shall ‘mutatis mutandis’ apply to Branch Youth Assembly and Extraordinary Meeting of the Branch Youth Assembly respectively.

 

(13) COMPOSITION OF BRANCH YOUTH ASSEMBLY

 

The Branch Youth Assembly shall consist of all the Youth Members in the Branch Members’ Register.

 

(14) BRANCH YOUTH COMMITTEE

 

The Branch Youth Committee shall consist of the following office-bearers:

14.1 A Branch Youth Chairman;
14.2 A Branch Youth Deputy Chairman;
14.3 A Branch Youth Vice-Chairman
14.3A Another Branch Youth Vice-Chairman who shall be appointed by the Branch Youth Chairman;
14.4 A Branch Youth Secretary
14.5 A Branch Youth Assistant Secretary
14.5A A Branch Youth Deputy Assistant Secretary who shall be appointed by the Branch Youth Chairman;
14.6 A Branch Youth Treasurer
14.6A A Branch Youth Deputy Treasurer who shall be appointed by the Branch Youth Chairman;
14.7 A Branch Youth Auditor;
14.8 At least two (2) but not exceeding ten (10) Branch Youth Committee Members as the Branch Youth Committee may think fit to elect.
14.8A It is a mandatory requirement that no less than 30% of the Committee Members elected under Article 14.8 above shall be female members;
14.9 It is a mandatory requirement that no less than 30% of the total number of office bearers under Articles 14.1, 14.2, 14.3, 14.3A, 14.4, 14.5, 14.5A, 14.6, 14.6A and 14.7 above shall be female members.

 

(15) ELECTION

 

All members of the Branch Youth Committee shall be elected by the Branch Youth Assembly consisting of the Branch Youth Members at which elections are held. The Chairman of the Branch Youth Section shall also hold the post of Vice-Chairman of the MCA Branch Committee.

 

(16) RESIGNATION, DEATH OR REMOVAL

 

If the Branch Youth Chairman shall cease to hold his office for any reason whatsoever, the Branch Youth Deputy Chairman shall hold that office as Branch Youth Chairman until the next Branch Youth Assembly at which elections of office-bearers are held. The vacant post of the Branch Youth Deputy Chairman shall forthwith be filled by the remaining members of the Branch Youth Committee electing one of themselves to be the Deputy Branch Youth Chairman who shall hold that office until the next Branch Youth Assembly at which elections of office-bearers are held.

16.1 If the Branch Youth Chairman shall cease to hold his office for any reason whatsoever, the Branch Youth Deputy Chairman shall hold that office as Branch Youth Chairman until the next Branch Youth Assembly at which elections of office-bearers are held. The vacant post of the Branch Youth Deputy Chairman shall forthwith be filled by the remaining members of the Branch Youth Committee electing one of themselves to be the Deputy Branch Youth Chairman who shall hold that office until the next Branch Youth Assembly at which elections of office-bearers are held.
16.2 Any member of the Branch Youth Committee may resign from his office by letter to the Branch Youth Chairman giving his reasons. The Branch Youth Committee shall consider his resignation at the Branch Youth Committee meeting next after the submission of the letter of resignation. In the event of a member of the Branch Youth Committee ceases to hold office due to his death, resignation, removal, the Youth Committee shall have power to fill the vacancy until the next Branch Youth Assembly at which elections of office-bearers are held.  
16.3 If half or more of the elected members of the Branch Youth Committee shall at any time cease to be members of the Branch Youth Committee then the procedure laid down in Article 41 of the MCA Constitution relating to the election of a New Central Committee shall be observed and followed.

 

(17) BRANCH YOUTH COMMITTEE MEETINGS

 

Articles 108, 109, and 110 of the MCA Constitution relating to MCA Branch Committee Meetings shall ‘mutatis mutandis’ apply to Branch Youth Committee Meetings except that Branch Youth Committee shall meet at least once in two (2) months.

 

(18) POWERS OF BRANCH YOUTH COMMITTEE

 

Articles 107 and 111 of the MCA Constitution relating to duties, power and responsibilities of MCA Branch Committee shall ‘mutatis mutandis’ apply to the Branch Youth Committee.

 

(19) BRANCH YOUTH SECRETARIAT

 

The Branch Youth Secretariat shall be situated in the same premises as the Secretariat of the Branch.

 

(20) DELEGATES TO DIVISIONAL, STATE YOUTH ASSEMBLIES

 

During the Branch Youth Assembly at which elections of office-bearers are held, besides electing the Branch Youth Committee, the assembly shall also elect:

20.1

At least six (6) but a maximum of twelve (12) Branch Youth delegates to the Divisional Youth Assembly. The first six (6) Branch Youth delegates shall be elected based on the first batch of twenty-five (25) Youth members in the Branch Youth Members’ Register and thereafter the election of the additional numbers of Branch Youth delegates to the Divisional Youth Assembly shall be based on the ratio of one (1) Branch Youth delegate to every twenty-five (25) Youth members in the Branch Youth Members’ Register, until the maximum number of twelve (12) Branch delegates is reached; PROVIDED ALWAYS that at least one (1) of the elected Branch Youth delegates shall be of the age of thirty five (35) or below;

20.2 At least two (2) but a maximum of five (5) Branch Youth delegates to the State Youth Assembly. The first two (2) Branch Youth delegates shall be elected based on the first batch of twenty-five (25) Youth members in the Branch Youth Members’ Register and thereafter the election of the additional numbers of Branch Youth delegates to the State Youth Assembly shall be based on the ratio of one (1) Branch Youth delegate to every fifty (50) Youth Members in the Branch Youth Members’ Register until the maximum number of five (5) Branch Youth delegates is reached.
20.2A

It is a mandatory requirement that no less than 30% of the delegates elected under Articles 20.1 and 20.2 above shall be female members.

 


PART V – DIVISIONAL YOUTH SECTION


 

(21) ESTABLISHMENT

 

A Divisional Youth Section shall be deemed established in any MCA Division which has one hundred (100) or more Youth Members in its Members’ Register.

(23) EXECUTIVE AUTHORITY

 

Subject to the Bye-Laws, Standing Rules and Orders, the executive authority of a Divisional Youth Section is vested in the Divisional Youth Executive Council which shall be constituted in accordance with Bye-Law 53. The said authority shall be exercised under the direction of the Divisional Youth Committee and the Divisional Youth Assembly.

 

(24) DIVISIONAL YOUTH ASSEMBLY

 

Articles 69, 70, 71, 72 and 75 of the MCA Constitution relating to MCA Divisional Assembly and Extraordinary Meeting of the Divisional Assembly shall ‘mutatis mutandis’ apply to the Divisional Youth Assembly and Extraordinary Meeting of the Divisional Youth Assembly respectively.

 

(25) DIVISIONAL YOUTH COMMITTEE

 

The Divisional Youth Committee shall consist of the following office-bearers:

25.1 A Divisional Youth Chairman;
25.2 A Divisional Youth Deputy Chairman;
25.3 Four (4) Divisional Youth Vice-Chairman and at least one of whom shall be of the age of thirty five (35) or below;
25.3A It is a mandatory requirement that at least one (1) of the four Vice-Chairman mentioned in Article 25.3 above shall be a female member;
25.4 A Divisional Youth Secretary;
25.5 A Divisional Youth Deputy Secretary;
25.5A A Divisional Youth Deputy Assistant Secretary who shall be appointed by the Divisional Youth Chairman;
25.6 A Divisional Youth Treasurer;
25.6A A Divisional Youth Deputy Treasurer who shall be appointed by the Divisional Youth Chairman;
25.7 A Divisional Youth Organizing Secretary to be appointed by the Divisional Youth Chairman from amongst the members of the Divisional Youth Committee.
25.7A Two (2) Divisional Youth Deputy Organizing Secretary who shall be appointed by the Divisional Youth Chairman;
25.8 A Divisional Youth Auditor;
25.9 At least two (2) but not exceeding ten (10) Divisional Youth Committee Members.
25.9A At least one (1) but not exceeding five (5) Divisional Youth Committee Members who shall be of the age of thirty five (35) or below;
25.9AA

It is a mandatory requirement that no less than 30% of the Divisional Youth Committee Members elected under Article 25.9  above shall be female members;

25.10 No more than nine (9) members of the Youth Section to be appointed by the Divisional Youth Chairman PROVIDED ALWAYS at least two (2) of the nine (9) appointed members shall be of the age of thirty five (35) or below as at the date of the relevant appointment;
25.10A It is a mandatory requirement that no less than 30% of the members appointed under Article 25.10 above shall be female members.
25.11 All Chairman of the Branch Youth Section within the Divisional Youth Section shall be Divisional Youth Committee Members. Such posts cannot be delegated.
25.12 It is a mandatory requirement that no less than 30% of the total number of office bearers under Articles 25.1, 25.2, 25.3, 25.4, 25.5, 25.5A, 25.6, 25.6A, 25.7, 25.7A and 25.8 above shall be female members.

 

(26) ELECTION

 

All members of the Divisional Youth Committee other than those mentioned in Sub-Clause 25.7, 25.10, and 25.11 above shall be elected by the Divisional Youth Assembly at which elections of office-bearers are held. The Chairman of the Divisional Youth Section shall also hold the post of Vice-Chairman in the MCA Divisional Committee.

 

(27) RESIGNATION, DEATH OR DEATH

27.1 If the Divisional Youth Chairman shall cease to hold his office, for any reason whatsoever, the Divisional Youth Deputy Chairman shall hold that office as Divisional Youth Chairman until the next Divisional Youth Assembly at which elections of office-bearers are held. The vacant post of the Divisional Youth Deputy Chairman shall forthwith be filled by the remaining members of the Divisional Youth Committee electing one of themselves to be Divisional Youth Deputy Chairman who shall hold that office until next Divisional Youth Assembly at which elections of office-bearers are held.
27.2 Any member of the Divisional Youth Committee may resign his office by letter to the Divisional Youth Chairman giving his reasons. The Divisional Youth Committee shall consider his resignation at a Divisional Youth Committee meeting next after the submission of the letter of resignation. In the event of a member of the Divisional Youth Committee ceasing to hold office due to his death, resignation or removal, the Divisional Youth Committee shall have power to fill the vacancy until the next Divisional Youth Assembly at which elections are held.
27.3 If half or more of the elected members of the Divisional Youth Committee shall at any time cease to be members of the Divisional Youth Committee then the procedure laid down in Article 41 of the MCA Constitution relating to the election of a New Central Committee shall be observed and followed.

(28) DIVISIONAL YOUTH COMMITTEE MEETINGS

 

Articles 82, 83, 84, 85 of the MCA Constitution relating to MCA Divisional Committee Meetings shall ‘mutatis mutandis’ apply to the Divisional Youth Committee Meetings except that the Divisional Youth Committee shall meet at least once in two (2) months.

 

(29) POWER OF DIVISIONAL YOUTH COMMITTEE

 

Article 86 of the MCA Constitution relating to the duties, powers and responsibilities of the MCA Divisional Committee shall ‘mutatis mutandis’ apply to the MCA Divisional Youth Committee.

 

(30) DIVISIONAL YOUTH SECRETARIAT

 

The Divisional Youth Secretariat shall be situated at the same premises as the Secretariat of the MCA Divisional Committee.

 

(31) COMPOSITION OF DIVISIONAL YOUTH ASSEMBLY

 

The Divisional Youth Assembly shall consist at least six (6) but a maximum of twelve (12) Branch Youth delegates from each of the MCA Branches established in the Division duly elected at the respective Branch Youth Assemblies under Sub-Clause 20.1.

 

(32) DELEGATES TO STATE AND NATIONAL YOUTH GENERAL ASSEMBLIES

 

During the Divisional Youth Assembly at which elections of office-bearers are held, besides electing the Divisional Youth Committee, the Assembly shall also elect:

32.1 Six (6) delegates to the State Youth Assembly; and
32.1A It is a mandatory requirement that at least two (2) of the six delegates mentioned in Article 32.1 above shall be female members.
32.2 Delegates to the National Youth General Assembly:
 
a. Seven (7) delegates for up to the first 250 members in
            benefit in its Divisional Register of members;
b. One (1) delegates for every 250 members in benefit for the next 2,250 members in benefit in its Divisional Register of members;
c. One (1) delegates for every 500 members in benefit for the next 2,500 members in its Divisional Register of members;
d. One (1) delegates for every 1,000 members in benefit for the remaining members in benefit its Divisional Register of members until the total number of delegates elected herein this article reaches the maximum number of 52 delegates to the National Youth General Assembly;
Provided always that at least one (1) of the elected delegates to the National Youth General Assembly shall be of the age of thirty five (35) or below;
e. The Chairman of the Divisional Youth Section shall be delegate to the National Youth General Assembly. Such post cannot be delegated.
32.2A It is a mandatory requirement that no less than 30% of the delegates elected under Article 32.2 above shall be female members.

 


PART VI – STATE YOUTH SECTION


 

(33) ESTABLISHMENT

 

Unless otherwise directed by the Youth Section Central Committee, there shall be established in each State in Malaysia, a State Youth Section with specific powers to supervise the Divisional and Branch Youth Sections in the State.

 

(34) CONFIRMATION

 

The establishment of a State Youth Section must be officially confirmed and recognized by the Youth Section Central Committee.

 

(35) EXECUTIVE AUTHORITY

Subject to these Bye-Laws, Standing Rules and Orders, the executive authority of a State Youth Section is vested in the State Youth Executive Council which shall be constituted in accordance with Bye-Laws 53. The said authority shall be exercised under the direction of the State Youth Committee and the State Youth Assembly.

 

(36) STATE YOUTH ASSEMBLY

 

Articles 69, 70, 71, 72 and 75 of the MCA Constitution relating to MCA Divisional Assembly and Extraordinary Meeting of the Divisional Assembly shall ‘mutatis mutandis’ apply to State Youth Assembly and Extraordinary Meeting of the State Youth Assembly respectively.

 

(37) STATE YOUTH COMMITTEE

 

The State Youth Committee shall consist of the following office-bearers:

37.1 A State Youth Chairman;
37.2 A State Youth Deputy Chairman;
37.3 Four (4) State Youth Vice-Chairman;
37.3A It is a mandatory requirement that at least one (1) of the four Vice-Chairman mentioned in Article 37.3 above shall be a female member;
37.4 A State Youth Secretary;
37.5 A State Youth Deputy Secretary;
37.5A A State Youth Deputy Assistant Secretary who shall be appointed by the State Youth Chairman;
37.6 A State Youth Treasurer;
37.6A A State Youth Deputy Treasurer who shall be appointed by the State Youth Chairman;
37.7 A State Youth Organizing Secretary to be appointed by the State Youth Chairman from amongst the members of the State Youth Committee;
37.7A Two (2) State Youth Deputy Organizing Secretary who shall be appointed by the State Youth Chairman;
37.8 A State Youth Auditor;
37.9 Fifteen (15) elected State Youth Committee Members and at least five (5) of whom shall be of the age of thirty five (35) or below;
37.9A It is a mandatory requirement that no less than 30% of the State Youth Committee Members elected under Article 37.9 above shall be female members;
37.10 No more than nine (9) members of the Youth Section to be appointed by the State Youth Chairman where at least two (2) of the nine (9) appointed members shall be of the age of thirty five (35) or below as at the date of the relevant appointment;
37.10A It is a mandatory requirement that no less than 30% of the members appointed under Article 37.10 above shall be female members.
37.11 All Chairman of the Divisional Youth Section shall be State Youth Committee Members. Such posts cannot be delegated.
37.11 It is a mandatory requirement that no less than 30% of the total number of office bearers under Articles 37.1, 37.2, 37.3, 37.4, 37.5, 37.5A, 37.6, 37.6A, 37.7, 37.7A and 37.8 above shall be female members.

 

(38) ELECTION

 

All members of the State Youth Committee other than those mentioned in Sub-Clause 37.7, 37.10 and 37.11 above shall be elected by the State Youth Assembly at which elections of office-bearers are held. The Chairman of the State Youth Section shall also hold the post of Vice-Chairman in the MCA State Liaison Committee.

 

(39) RESIGNATION, DEATH OR REMOVAL

39.1 If the State Youth Chairman shall cease to hold his office for any reason whatsoever, the State Youth Deputy Chairman shall hold that office as State Youth Chairman until the next State Youth Assembly at which elections of office-bearers are held. The vacant post of the State Youth Deputy Chairman shall forthwith be filled by the remaining members of the State Youth Committee electing one of themselves to be the State Youth Deputy Chairman who shall hold that office until the next State Youth Assembly at which elections of office-bearers are held.
39.2 Any member of the State Youth Committee may resign from his office by letter to the State Youth Chairman giving his reasons. The State Youth Committee shall consider his resignation at the State Youth Committee Meeting next after the submission of the letter of resignation. In the event of a member of the State Youth Committee ceases to hold office due to his death, resignation or removal, the State Youth Committee shall have power to fill the vacancy until the next State Youth Assembly at which elections are held.
39.3 If half or more of the elected members of the State Youth Committee shall at any time cease to be members of the State Youth Committee then the procedure laid down in Article 41 of the MCA Constitution relating to the election of a New Central Committee shall be observed and followed.

(40) STATE YOUTH COMMITTEE MEETINGS

 

Articles 56, 57 and 58 of the MCA Constitution relating to meetings of a State Liaison Committee shall ‘mutatis mutandis’ apply to the State Youth Committee.

 

(41) POWERS OF STATE YOUTH COMMITTEE

 

Article 59 of the MCA Constitution relating to duties, powers and responsibilities of a State Liaison Committee shall ‘mutatis mutandis’ apply to the MCA State Youth Committee.

 

(42) COMPOSITION OF STATE YOUTH ASSEMBLY

 

The State Youth Assembly shall consist of:

42.1 At least two (2) but not exceeding five (5) Branch Youth delegates from each of the Branch Youth Section established in the State, duly elected at the respective Branch Youth Assemblies under Sub-Clause 20.2;
42.2 Six (6) Divisional Youth Delegates from each of the Divisional Youth Section established in the State, duly elected at the respective Divisional Youth Assemblies under Sub-Clause 32.1.

(43) DELEGATES TO NATIONAL YOUTH GENERAL ASSEMBLY

43.1 During the State Youth Assembly at which elections of office-bearers are held, besides electing the State Youth Committee, the Assembly shall also elect seven (7) Youth delegates to the National Youth General Assembly where at least one (1) of whom shall be of the age of thirty five (35) or below.
43.1A It is a mandatory requirement that at least two (2) of the seven delegates mentioned in Article 43.1 above shall be female members.
43.2 The Chairman of the State Youth Section shall be delegate to the National Youth General Assembly. Such posts cannot be delegated.

(44) STATE YOUTH OFFICE AND SECRETARIAT

44. The State Youth Office and Secretariat shall be established at the same premises as the relevant MCA STATE LIAISON COMMITTEE OFFICE and SECRETARIAT and the contents of Articles 61, 62, 63 and 64 of the MCA Constitution shall ‘mutatis mutandis’ apply there to.


PART VII – NATIONAL YOUTH SECTION


 

(45) NATIONAL YOUTH GENERAL ASSEMBLY

45. Articles 27, 28, 29, 30, 31, 32, 33, 35, 36 and 37 of the MCA Constitution relating to functions and powers of the MCA General Assembly and Extraordinary Meeting of the General Assembly shall ‘mutatis mutandis’ apply to National Youth General Assembly and Extraordinary Meeting of the National Youth General Assembly respectively.

(46) COMPOSITION OF NATIONAL YOUTH GENERAL ASSEMBLY

The National Youth General Assembly shall consist of the following National Youth Delegates:

46.1 Divisional Youth Delegates from each of the MCA Divisional Youth Section duly elected at the respective Divisional Youth Assemblies under Sub-Clause 32.2;
 
a. Seven (7) delegates for up to the first 250 members in benefit in its Divisional Register of members;
b. One (1) delegate for every 250 members in benefit for the next 2250 members in benefit in its Divisional Register of members;
c. One (1) delegate for every 500 members in benefit for the next 2500 members in its Divisional Register of members;
d. One (1) delegate for every 1000 members in benefit for the remaining members in benefit in its Divisional Register of members until the total number of delegate elected herein this article reaches the maximum number of 52 delegates to the National Youth General Assembly;
e. The Chairman of the Divisional Youth Section shall be delegate to the National Youth General Assembly. Such posts cannot be delegated.
46.2
a. Seven (7) State Youth Delegates from each of the State Youth Sections duly elected at the respective State Youth Assemblies under Clause 43;
b. All Chairman of the State Youth Section shall be delegate to the National Youth General Assembly. Such posts cannot be delegated.
46.3 All the incumbent members of the Youth Section Central Committee.

(47) YOUTH SECTION CENTRAL COMMITTEE

 

The Youth Section Central Committee shall consist of the following office-bearers:

47.1 A National Youth Chairman;
47.2 A National Youth Deputy Chairman;
47.3 Four (4) National Youth Vice-Chairman;
47.3A It is a mandatory requirement that at least one (1) of the four Vice-Chairman mentioned in Article 47.3 above shall be a female member;
47.4 A National Youth Secretary-General;
47.5 A National Youth Deputy Secretary-General;
47.5A Notwithstanding Article 48 below, the post of National Youth Deputy Secretary-General mentioned in Article 47.5 above shall be appointed by the National Youth Chairman;
47.5AA A National Youth Assistant Deputy Secretary-General who shall be appointed by the National Youth Chairman;
47.6 A National Youth Treasurer-General;
47.6A A National Youth Deputy Treasurer-General;
47.6AA Notwithstanding Article 48 below, the post of National Youth Deputy Treasurer-General mentioned in Article 47.6A above shall be appointed by the National Youth Chairman;
47.7 A National Youth Organizing Secretary to be appointed by the National Youth Chairman from amongst the members of the Youth Section Central Committee;
47.8 A National Youth Auditor;
47.9 Twenty-Five (25) elected National Youth Committee Members where at least five (5) of whom shall be of the age of thirty five (35) or below;
47.9A It is a mandatory requirement that no less than 30% of the National Youth Committee Members elected under Article 47.9 above shall be female members;
47.10 Every State Youth Chairman provided he has not been elected to any of the posts listed above;
47.11 No more than ten (10) members of the Youth Section to be appointed by the National Chairman and at least two (2) of the ten (10) appointed members shall be of the age of thirty five (35) or below as at the date of the relevant appointment;
47.11A It is a mandatory requirement that no less that 30% of the members appointed under Article 47.11 above shall be female members;
47.12 It is a mandatory requirement that no less than 30% of the total number of office bearers under Articles 47.1, 47.2, 47.3, 47.4, 47.5, 47.5AA, 47.6, 47.6A, 47.7 and 47.8 shall be female members.

(48) ELECTION

 

All members of the MCA Youth Central Committee other than those mentioned in Sub-Clause 47.7, 47.10 and 47.11 shall be elected by the Delegates at the National Youth General Assembly at which elections of office-bearers are held.

 

(49) NATIONAL YOUTH CHAIRMAN

49.1 Notwithstanding Clause 5 of the Bye-Laws, no age limit is imposed on the National Youth Chairman. Any National Youth Delegate, including all the incumbent members of the Youth Section Central Committee referred to in Clause 46.3 hereof, shall be eligible to be nominated as a candidate for and elected to the post of the National Youth Chairman, provided always that such nomination must be proposed and seconded by two (2) duly elected National Youth Delegates.
49.2 The National Chairman of the MCA Youth Section shall also hold the post of Vice-President in the MCA Central Committee.
49.3 No person shall hold the office of the National Youth Chairman for more than nine (9) years from the date he is elected or from the date he assumes his office under Bye-Law 50.1 of the Youth Section Bye-Law.

(50) RESIGNATION, DEATH OR REMOVAL

50.1

If the National Youth Chairman shall cease to hold his office for any reason whatsoever, the National Deputy Youth Chairman shall hold that office as National Youth Chairman until the next National Youth General Assembly at which elections of office bearers are held. The vacant office of the National Youth Deputy Chairman shall forthwith be filled by the remaining members of the Youth Section Central Committee electing one of themselves to be the National Youth Deputy Chairman who shall hold that office as the National Youth Deputy Chairman until the next National Youth General Assembly at which elections of office-bearers are held.

50.2 A Member of the MCA Youth Central Committee may resign from his office by a letter to the National Youth Chairman giving his reasons. The MCA Youth Central Committee shall consider his resignation at the MCA Youth Central Committee meeting next after the submission of the letter of resignation. In the event of any of the elected member of the MCA Youth Central Committee ceasing to hold office for whatsoever reason, the MCA Youth Central Committee may appoint another to fill the vacancy until the next National Youth General Assembly in which elections of office-bearers are held.
50.3 If half (1/2) or more of the member of the Youth Section Central Committee shall at any time cease to be members of the Youth Section Central Committee, the procedure laid down in Article 41 of the MCA Constitution relating to the elections of a New Central Committee shall be observed and followed.

(51) YOUTH SECTION CENTRAL COMMITTEE MEETINGS

 

Articles 43 and 44 of the MCA Constitution relating to meetings of MCA Central Committee shall ‘mutatis mutandis’ apply to the Youth Section Central Committee.

 

(52) POWERS OF YOUTH SECTION CENTRAL COMMITTEE

 

Articles 39 and 45 of the MCA Constitution relating to responsibilities, duties and power of MCA Central Committee shall ‘mutatis mutandis’ apply to the Youth Section Central Committee.

 

(53) YOUTH EXECUTIVE COUNCIL

53.1 There shall be established from amongst the members of the Youth Section Central Committee an Executive Council which shall consist of the National Youth Chairman, National Youth Deputy Chairman, the Four National Youth Vice-Chairman, the National Youth Secretary-General, the National Youth Deputy Secretary-General, the National Youth Treasurer General, the National Youth Deputy Treasurer-General, the National Youth Organizing Secretary, the National Youth Auditor and not more than ten (10) other members of the Youth Section Central Committee appointed by the National Youth Chairman in his absolute discretion deems fit who likewise may terminate such appointment if and when he thinks fit.
53.1A In addition to the list of members mentioned in Article 53.1 above, it shall be added the post of Assistant Deputy Secretary-General also to be a member in the Youth Executive Council.
53.2 Without prejudice to the generality of the powers conferred by these Bye-Laws, the Executive Council shall be the body responsible for the administrative affairs of the National Youth Section under the authority and direction of the National Youth General Assembly and the Youth Section Central Committee. It shall be deemed to have been delegated and sub-delegated by, and vested with all the powers of the National Youth General Assembly pursuant to Bye-Laws 45 hereof and the Youth Section Central Committee pursuant to Bye-law 52 hereof with powers to sub-delegate and to do any acts either general or specific but it must report its activities to the next meeting of the Youth Section Central Committee. The Executive Councils shall meet as and when required by the National Youth Chairman giving not less than twenty-four (24) hours’ notice.
53.3 Bye-Laws 53.1 and 53.2 above shall ‘mutatis mutandis’ apply to the State Youth Committee as well as Divisional Youth Committee.

(54) NATIONAL YOUTH SECTION HEADQUARTERS

 

The headquarters of the National Youth Section shall be situated at the same premises as the MCA Headquarters.

 


PART VIII – BUREAUX FOR SPECIAL FUNCTION


 

(55) ESTABLISHMENT

 

There may be established at the National Youth Section Headquarters one or more Bureaux for Special Functions. The compositions, terms or reference, functions and powers of these Bureaux shall be laid down in writing from time to time under instruments issued by the National Youth Chairman in Consultation with the MCA President.

 


PART IX – AD-HOC COMMITTEES AND SUB-COMMITTEES


 

(56) ESTABLISHMENT

 

Without prejudice to the generality of the powers conferred by these Bye-Laws, the National Youth General Assembly or the Youth Section Central Committee may from time to time establish Ad Hoc Committees or Sub-Committees. The composition, functions and powers of each Ad Hoc Committee shall be stated in writing at the time of the appointment of such Committee or Sub-Committee.

 


PART X – MEETINGS


 

(57) QUORUM

57.1 Unless otherwise provided the quorum for the conduct of proceedings of the Branch, Divisional, State and General Assembly shall be as follows:
 
a. Branch Youth Assembly
The presence of at least fifteen (15) or one-third (1/3) of the number of members entitled to attend the meeting, whichever is lesser.
b. Divisional Youth Assembly The presence of at least twenty-five (25) or one-third (1/3) of the number of delegates entitled to attend, whichever is lesser.
c. State Youth Assembly The presence of at least fifty (50) or one-third (1/3) of the number of delegates entitled to attend, whichever is lesser.
d. National Youth General Assembly
e. The presence of at least two hundred (200) or one-third (1/3) of the number of delegates entitled to attend, whichever is lesser.
57.2 Unless otherwise provided the Quorum for the conduct of proceedings of any meeting shall be the presence at all time of one-third (1/3) the number of members entitled to attend the meeting.
57.3 Provided always that in any meeting at any level of the Youth Section where there is a lack of Quorum thirty (30) minutes after the meeting is scheduled to commence, such meeting shall stand adjourned for one (1) week at the same place and time as the meeting which notice has been given and the adjourned meeting thereafter shall proceed irrespective of the existence or otherwise of a Quorum and any resolutions arising therefore shall not be invalidated by reason of lack of a Quorum.

 


PART XI – ELECTION


 

ELECTION OF OFFICE BEARERS

58. The election of office-bearers at all levels of the Youth Section shall be held in accordance with the provisions of the MCA Constitution.

PART XII – GENERAL PROVISION


 

OTHER MATTERS

59. Any other matter or matters not specifically provided for or dealt with in these By-Laws shall be dealt with in accordance with the provisions of the MCA Constitution.

 

INTERPRETATION

60. In case of any dispute as to the interpretation, construction, rendering and meaning of all or any of the provisions, or any of the word or words, phrase or phrases contained in these Bye-Laws, the interpretation, construction, rendering and meaning determined and fixed by the Youth Section Central Committee shall be final and conclusive and not subject to question by or in any Court of Law.
60A. In respect of calculation of the 30% requirement in this bye-law, the method of calculation shall be as follows; in the event the figure after the decimal point is five or above, the sum shall be rounded up. In the event the figure after the decimal point is below five, the sum shall be rounded down.
60B. Words and expressions importing the masculine gender include female.

 

POWERS OF MCA PRESIDENT

61. The President of the MCA in his discretion and after consultation with the Youth Section Central Committee may suspend the Membership of any Youth Member or dissolve any level of the Youth Section for acting in a manner prejudicial to the interest of the Party. This provision is in addition to and not in derogation of any of the provisions set out under Part XV of the MCA Constitution.

PART XIII – TRANSITIONAL PROVISIONS


62. Until new Office-bearers are elected pursuant to this Bye-Law, the existing Office-Bearers under the 1997 MCA Youth Section Bye-Laws shall be deemed, for all intents and purposes to be, and to be capable of, acting in their respective capabilities or collectively as members of any Committee.
62A. For purpose of removal of doubt, the amendments as approved and adopted by the MCA Central Committee on 11th January 2011 to the number of delegates or members in Articles 20.1, 20.2, 25.10, 31、32.1, 32.2, 43.1, and 47.11 of this bye-laws shall, once become operative, be effective and applicable only for two (2) consecutive terms of party elections.
62B. For purpose of removal of doubt, the insertions and the whole of Articles 14.3A, 14.5A, 14.6A, 14.8A, 14.9, 20.2A, 25.3A, 25.5A, 25.6A, 25.7A, 25.9AA, 25.10A, 25.12, 32.1A, 32.2A, 37.3A, 37.5A, 37.6A, 37.7A, 37.9A, 37.10A, 37.12, 43.1A, 47.3A, 47.5A, 47.5AA,  47.6AA, 47.9A, 47.11A, 47.12, 53.1A and 60A of this bye-laws as approved and adopted by the MCA Central Committee on 11th January 2011 shall once become operative, be effective and applicable only for two (2) consecutive terms of party elections.
